After delving into both sides of the coin so to speak, it has become apparant that the original plan did have provision for horse grazeing on the North field however, it was the Thames Gateway Development Corporation that had made the decision to cancel it as they did not want horse grazeing On the Belhus Country Park! Therefore a new plan was submitted by Rural Arisings to disclude the Horse Grazeing and then the plan was passed!
This issue should be taken up with Thames Gateway Development Corporation! The North site would take up to three years to complete anyway!
Belhus Land Ltd had followed legal procedure to vacate the original tenant/lessee with two months notice under the 364 day lease agreement as per rent contract which terms this lease as Not Permanant! In turn, only one months notice needed to be given to the sub tenant and one months notice to the sub sub tenants!
As of 1st April 2010, those Horse owners who remain on the land, do so Illegally!!
Alternative accomodation was offered to all horse owners, some had found there own, now leaving aprox three horseowners on site! Mediation has been offered by A member of the Flowers Estate Community group, to organise a meeting between all Parties involved. To date this has not been taken up by the Horse owners, however Belhus land has agreed to meet with them to bring this issue to a conclusion!
Rural Arisings need to get onto this part of the land to carry out important tests, especially after the amount of rainfall that has soaked through the thin layer of soil that covers the chemicals underneath. They cannot enter this part of the land while the horses are roaming free, because of the danger to staff and their vehicles would be a danger to the horses. Ural Arisings also need to build up all around the edges to prevent Bikers from gettin through to the Motorway, possibly causing carnage or even death!
PLEASE NOTE, THAT THIS ISSUE IS NOT WITH RURAL ARISINGS, WHO HAVE NO DURISTICTION OVER BELHUS LANDS LEGAL ISSUES WITH THE HORSE OWNERS!
SORA, had done their best to offer support to the horse owners left on site but as the information emerged and the complication of the illegal move to remain as tresspassers on this site, SORA had no option but to withdraw their support from this issue due the possibilty of being sued for supporting the action!
To sum up, Chris Savill (FEC) has agreed to mediate between Belhus Land Ltd and The Horse Owners that are left on site and is now awaiting confirmation of dates to be looked at! Bearing in mind that the end result would be to vacate the land, but with some compromise to give time to!
Let's hope this will be grasped with open arms and a conclusion reached!
